  1. GENERAL PROVISIONS.

1.1. The Seller provides and sells all services and content offered on buvesnakotnei.lv in accordance with these Terms. The Buyer or the User of the Site purchases and receives the service or product in accordance with the offer specified on the Site (hereinafter referred to as the “Order”). The Buyer acquires the right to use the goods or services and content upon full payment of the order fee.

1.2. By making a purchase of the goods and services offered on the website and agreeing to these Terms and Conditions, the buyer confirms that he/she is a person with legal capacity and has provided truthful personal data necessary for the performance of the contract. If the purchaser is a legal person, the person who has received the appropriate authorisation to make purchases shall act on its behalf. The Buyer confirms that he will use the Website in accordance with the laws and regulations, only in an authorised manner. In the event of a breach of the Terms and Conditions or the laws and regulations, the Seller shall have the right to withdraw from the contract for the purchase made by the Buyer and/or to prevent the Buyer from using the Site.

1.3. If the Buyer orders and purchases the goods and services offered on the Site and uses other content created by the Seller, the Buyer shall be deemed to have read and unreservedly accepts these Terms and the terms of the Distance Contract and undertakes to comply with them.

1.4. The Distance Contract (the “Contract”) is concluded between the Seller and the Buyer, who places an order and makes a purchase on the Site.

The Contract shall come into force when the Buyer has placed an order by means of distance communication and has received confirmation of the order from the Seller by electronic mail or telephone. The order and the acknowledgement of receipt shall be deemed to have been received when they are accessible to the person to whom they are addressed. The Contract shall remain in force until it has been performed, i.e. until the goods ordered have been handed over to the Buyer. The Contract applies to all orders and purchases made on the Website.

1.5. The Seller reserves the right to unilaterally modify and supplement the Terms at any time without notice by publishing them in the “User terms” section of the Website. The Buyer shall be bound by the terms and conditions in force at the time of ordering the goods and services. The Buyer is obliged to read these Terms and Conditions before making any purchase.

  1. SERVICES AND GOODS AVAILABLE ON THE SITE

2.1. The Buyer may purchase services, goods and content available on the Site. Items can be purchased while they are hosted on the Site.

2.2. In the event that the purchased service or content cannot be provided for technical or other reasons, the Seller shall inform the Buyer by e-mail or telephone in order to terminate the contract with a refund or, with the Buyer’s consent, to provide an equivalent service or to set a new deadline for the completion of the purchase.

2.3. The Seller reserves the right to unilaterally change the range and specification of services and goods available on the Site at any time without prior notice.

2.4. The webinars to which access can be purchased on the website are conducted online via the Zoom platform, requiring an internet connection and the latest version of the Zoom platform on the device from which the purchaser intends to participate in the webinar to access the webinar purchased.

2.4.1. In order to obtain a personal access link to the webinar, the buyer must register as a webinar participant by providing the participant’s name and email after the purchase has been processed and payment has been made. Access links are unique for each registered participant and can only be used on one device at a time.

2.4.2. By registering for the webinar, the buyer agrees not to distribute his/her individual access link. The Seller shall not be liable for any failure by the Buyer to comply with the terms and conditions set out in these Terms and Conditions.

2.4.3. Participation in selected webinars can earn qualification points towards the Certificate of Construction Practice and supervision of certified construction professionals. Information on whether qualification points are awarded for attending a specific webinar is available in the description of each webinar on the website. (only in Latvia)

2.4.3.1. The Seller shall send the confirmation of the allocation of qualification points to the webinar participants, approved by the Latvian Association of Civil Engineers, electronically after the webinar upon request.

2.5. The Professional Development Course for Businesses service is tailored to the buyer’s needs and can be delivered in the following ways of the buyer’s choice:

  • In person (at the buyer’s or seller’s premises or by agreement)
  • Remotely (in an online system provided by the seller via the Zoom platform)
  • Hybrid (course participants can join the class both in person and remotely)

2.5.1. The customer registers their interest in receiving the Professional Development Course service at the company by filling in the application form on the website. Upon receipt of the application, the Seller shall contact the Buyer via the contact method specified in the application form to clarify the details of the Buyer’s needs and to agree on the modalities of the service.

  1. PRICES AND DISCOUNTS

3.1. All prices for services and content provided on the Site are quoted in euros (€), subject to value added tax at the rate (21%) provided for by the laws and regulations. The prices quoted for services and goods are valid at the time the order is placed and the Buyer agrees to pay the quoted price by placing and confirming the order.

3.2. The Seller reserves the right to change the prices of goods and services, short-term discount offers and any other changes in payment arrangements at any time without notice. The Buyer shall purchase the service or goods at the price indicated at the time of purchase. If, for technical reasons, inaccurate or inappropriate prices for goods or services are published on the Website, the Seller shall inform the Buyer that the order cannot be fulfilled.

3.3. A discount code is a unique combination of letters and/or numbers that can be used to purchase discounted services. Discount codes are uniquely designed and each can provide a different amount of discount on services and each works under certain conditions, such as volume discounts when purchasing a certain number of goods or services. Discount codes can be obtained through marketing campaign materials or other information channels. To use a discount code, you must enter it in the “Enter promotion code” section of the shopping basket on the website and confirm its use by clicking on the “Add” button before checking out.

  1. ORDER PLACEMENT AND PAYMENTS

4.1. Orders can be placed at buvesnakotnei.lv. You do not need to register on the website to place an order.

4.1.1. The customer selects the specific services and goods available on the website by placing them in their shopping basket. After placing the desired services or goods in the basket, confirm the order by clicking on the “Checkout” button

4.1.2. When placing an order, the buyer enters the necessary contact details in the order form and selects the payment method (credit card or bank transfer).

4.1.3. After the order has been placed, the buyer receives an electronic notification with the order details and, if the chosen payment method is by bank transfer, the details for payment.

4.1.4. The Parties agree that invoices shall be drawn up electronically and shall be valid without signature. If an invoice is not paid by the due date stated therein or is paid late, the service may not be performed.

Payment must be made to the Seller’s account LV89RIKO0002930371025 at Luminor bank. When paying the invoice, the order number must be indicated in the payment order!

4.2. By placing an order on the Site, the Buyer agrees to pay for the services, content and goods added to the order.

4.3. Payments for services, goods and content available on the Site are prepaid

4.4. By placing an order on the Site and paying for it, the Customer confirms that he/she has read the Terms of Use of the Site.

4.6. After placing an order, the Buyer will receive an order confirmation by e-mail, in which the Buyer is obliged to verify that all the data and information provided are correct and correspond to the order placed.   1. OTHER PROVISIONS

5.1. The Buyer agrees to the processing of the personal data provided at the time of placing the order for the purposes of the execution of the order (distance contract) and the processing of payments.

5.2. The Site uses cookies. By using the Site and the content contained therein, the Buyer agrees to the use of cookies used on the Site for analytical and performance purposes.

5.3. By visiting and placing orders on the Site, the Buyer agrees to these Terms and agrees to comply with them. The Seller has the right to amend these terms at any time by posting them on the Site and the Buyer is obliged to review the terms before placing orders on the Site.

5.4. The Seller accepts no responsibility or risk if the Buyer has not read and complied with these Terms and Conditions and the Site Privacy policy

5.5. The Seller has the right to use the Buyer’s data – telephone number and e-mail address for marketing activities and market research, to inform about the Seller’s services, as well as for the delivery of commercial communications.

5.6. The Buyer has the right to prohibit the use of his personal data for marketing activities and market research, as well as for information about the Seller’s services and the delivery of commercial communications.
